K's Mobile Notary Service
Effective Date: January 1, 2025

1. ACCEPTANCE OF TERMS

By engaging K's Mobile Notary Service ("Service") for notarization services through any means including but not limited to: visiting this website, sending text messages to 904-345-0526, making phone calls, or requesting notarization services, you ("Client") agree to be bound by these Terms of Service. General website browsing and telephone inquiries do not constitute acceptance. If you do not agree to these terms, do not request notarization services.

2. SCOPE OF NOTARY SERVICES

K's Mobile Notary Service provides notarization services ONLY. We are not lawyers and do not provide legal advice. Our services are limited to:

  • Witnessing signatures on documents
  • Verifying identity of signers
  • Applying notary seal and signature
  • Maintaining notary journal records as required by law

We DO NOT:

  • Provide legal advice or document preparation
  • Guarantee the legal validity of your documents
  • Explain document contents or legal implications
  • Notarize documents with blank spaces (unless permitted by law)

3. ADDITIONAL SERVICES & FEES

IMPORTANT: The following services are NOT included in standard notary fees and incur additional charges:

  • Copying documents: $2.00 per page
  • Scanning documents: $5.00 per document
  • Printing services: $1.00 per page
  • Mailing documents: $10.00 handling + postage costs
  • Faxing: $5.00 per transmission
  • Document storage: $30.00 per month after 24 hours
  • Services outside business hours: 150% surcharge

NO DEMANDS POLICY: Clients may not demand these additional services. They are offered at our sole discretion and availability.

4. PAYMENT TERMS & LIEN RIGHTS

PAYMENT IS DUE IMMEDIATELY UPON APPLICATION OF NOTARY SEAL. NO EXCEPTIONS.

  • Business Clients: Are prohibited from requesting invoices. Payment must be made immediately when notary seal is applied.
  • No Credit Terms: We do not extend credit under any circumstances
  • Processing Fees: $25.00 fee for declined payments or chargebacks
  • Interest on Unpaid Accounts: 1.5% per month (18% annually) on all unpaid balances
  • Collection Costs: Client responsible for all collection costs including 25% collection fee and attorney fees
NOTARY LIEN NOTICE

K's Mobile Notary Service hereby claims and retains a possessory lien on ALL documents until payment is made in full. This includes but not limited to:

  • Original documents brought for notarization
  • Copies made during service
  • Any related paperwork or materials

Documents will be retained in our secure facility until all fees are paid. Storage fees of $30.00 per month begin 24 hours after service date.

5. CLIENT RESPONSIBILITIES

  • Valid ID Required: Government-issued photo ID mandatory - no exceptions
  • Document Preparation: Bring completed documents - we do not fill out forms
  • English Proficiency: Must understand English sufficiently to comprehend document contents
  • Voluntary Signing: Must be signing willingly without coercion
  • Mental Capacity: Must be of sound mind and not under influence of substances
  • Location Access: Provide safe, accessible location for mobile services
  • Parking: Client responsible for any parking fees or violations

6. CANCELLATION & NO-SHOW POLICY

  • 24-Hour Notice Required: Cancellations with less than 24 hours notice incur 50% service fee
  • No-Show Fee: $50.00 fee for missed appointments
  • Weather Delays: Service may be rescheduled for safety - no penalty
  • Client Unpreparedness: If documents are incomplete or signer lacks proper ID, full fees apply

7. NOTARY PROTECTION CLAUSES

Document Liability

Client acknowledges that K's Mobile Notary Service:

  • Cannot guarantee legal sufficiency of documents
  • Is not responsible for document contents or legal consequences
  • May refuse to notarize any document at sole discretion
  • Will report suspected fraud to authorities
Identification Verification

We reserve the right to:

  • Refuse service if ID appears altered or suspicious
  • Require additional identification if deemed necessary
  • Photograph ID for our records
  • Verify identity through additional means
Venue Safety

Client ensures meeting location is:

  • Safe and well-lit
  • Free from aggressive individuals
  • Free from dangerous conditions, dangerous pets, etc.
  • Equipped with a suitable writing surface
  • Accessible without trespassing
  • Free from illegal activities

8. LIMITATION OF LIABILITY

MAXIMUM LIABILITY IS LIMITED TO FEES PAID FOR SERVICES.

K's Mobile Notary Service shall not be liable for:

  • Consequential, incidental, or punitive damages
  • Lost profits or business opportunities
  • Document rejection by third parties
  • Delays caused by traffic, weather, or client unpreparedness
  • Technical failures of equipment
  • Acts of God or circumstances beyond our control

9. PROHIBITED ACTIVITIES

The following will result in immediate service termination and potential legal action:

  • Fraudulent documents or false identification
  • Harassment or abuse of notary staff
  • Requesting illegal notarizations
  • Recording conversations without consent
  • Demanding services beyond notary scope
  • Refusing to pay agreed-upon fees
  • Threatening behavior of any kind

13. DISPUTE RESOLUTION

COURT JURISDICTION:

  • All disputes will be resolved in the courts of Duval County, Florida
  • No class action lawsuits permitted
  • Florida law governs all interpretations
  • Prevailing party entitled to attorney fees
  • Exclusive venue for all court proceedings: Duval County, Florida

11. PRIVACY & RECORDS

  • Notary journal records maintained per Florida law
  • Client information may be shared with law enforcement if required
  • No expectation of privacy during notarization process
  • Audio/video recording may occur for security purposes

12. ONLINE REVIEW PROTECTION

LIQUIDATED DAMAGES FOR FALSE REVIEWS:

Client acknowledges that false, defamatory, or malicious online reviews cause significant and difficult-to-quantify harm to K's Mobile Notary Service's reputation and business.

If Client posts any online review (on Google, Yelp, Facebook, or any other platform) that is:

  • Factually inaccurate or false
  • Malicious, vindictive, or posted in bad faith
  • Contains defamatory statements
  • Is posted solely due to a fee dispute or Client's failure to pay

Client agrees to pay liquidated damages of $1,000.00 to compensate for:

  • Harm to business reputation and goodwill
  • Lost business and decreased search rankings
  • Time and costs required to address false reviews
  • Legal fees and costs if litigation becomes necessary

This liquidated damages provision does not prevent pursuit of additional legal remedies including injunctive relief and actual damages exceeding $1,000.00.

Note: Honest reviews reflecting genuine service experiences, even if negative, are not subject to this provision. This clause applies only to false, malicious, or bad faith reviews.

FINAL NOTICE

By proceeding with any communication or service request, you acknowledge:

  1. You have read and understood these Terms of Service
  2. You agree to all payment terms and fee structures
  3. You understand our lien rights on all documents
  4. You waive any right to demand additional services
  5. You accept all liability limitations and dispute resolution terms

These terms may be updated at any time. Continued use of services constitutes acceptance of modified terms.
