Florida Power of Attorney Requirements

General Requirements:

  • Must be signed by competent adult (18+)
  • Must be witnessed by two witnesses
  • Must be notarized by Florida notary
  • Witnesses cannot be related or beneficiaries
  • Agent/Attorney-in-fact cannot be witness

Special Considerations:

  • Durable POA survives incapacity
  • Non-durable POA ends if principal becomes incapacitated
  • Real estate POA must be recorded
  • Healthcare POA has specific statutory requirements
